1. Acceptance Of Terms
By booking a session, purchasing a gift card, or otherwise using MadMax Karting's services at any of our branches (Two Rivers, Waterfront, or Nanyuki Swara), you agree to the terms set out below. If you're booking on behalf of a group, school, or company, you're confirming that you have the authority to accept these terms for everyone in that booking.
2. Bookings & Payments
Bookings can be made online, over WhatsApp, or by phone. Prices shown at the time of booking are the prices you pay — we don't add charges after confirmation except where you request additional sessions, upgrades, or add-ons.
- Full payment is generally required to confirm a booking, unless you've arranged direct invoicing (available for corporate and school bookings).
- We accept M-Pesa, major debit and credit cards, and cash on arrival where applicable.
- Prices are subject to change, but any change will never apply to a booking you've already confirmed.
3. Cancellations, Refunds & Date Changes
We know plans change. Here's how we handle it:
- Cancellations made more than 24 hours before your slot are fully refundable.
- Cancellations inside 24 hours are not refundable, but we'll happily move your booking to a new date at no extra charge.
- No-shows without notice are treated as used bookings and are not refunded.
- Gift card purchases are non-refundable once issued, but never expire and can be used at any branch.
4. Age Requirements & Supervision
Minimum ages vary by branch and activity, and are listed on our Safety page. Racers under 18 require a parent or guardian to complete a signed waiver before participating. For group and school bookings, the organizer is responsible for ensuring appropriate supervision ratios are met.
5. Safety, Waivers & Assumption Of Risk
Karting, offroad driving, and related activities carry inherent physical risk, even with full safety equipment, briefings, and supervision in place. By participating, you acknowledge and accept this risk. A liability waiver is completed by every racer (or their parent/guardian, for under-18s) before any session begins. 6. Conduct On Premises
We want every visit to be safe and enjoyable for everyone on-site. MadMax staff and marshals may remove any participant from a session, without refund, for behavior that endangers themselves, other racers, or staff — including reckless driving, ignoring marshal instructions, or arriving under the influence of alcohol or drugs.
7. Gift Cards & Membership Terms
Gift cards never expire and may be used toward any booking, including birthday, corporate, and school packages. Racer Pass and Family Pass memberships renew annually and can be cancelled anytime before renewal with no cancellation fee — see our Membership page for full benefit details.
8. Liability & Limitation
MadMax Karting maintains public liability insurance across all branches. Except where caused by our negligence, we are not liable for indirect or consequential loss arising from your visit, including but not limited to travel costs, lost time, or personal property left on-site.
9. Intellectual Property
Photography, videos, lap-time result cards, and other content generated through your visit may be used by MadMax for marketing purposes unless you request otherwise in writing. The MadMax name, logo, and branding remain our property and may not be used without permission.
10. Changes To These Terms
We may update these terms from time to time to reflect changes in our services or applicable law. The version in effect at the time of your booking is the one that applies to it.
11. Governing Law
These terms are governed by the laws of Kenya. Any disputes will be subject to the jurisdiction of Kenyan courts.
